Preparing for a Reckless Driving Case: How to Help Your Lawyer

Between the summons and your court date, a few steps can make a real difference in how your case is prepared. Some help your lawyer test the evidence. Others show the prosecutor and the judge how you’ve responded. None guarantees a dismissal or a reduction, and the right steps depend on the charge, the evidence and your record.

Reckless driving preparation checklist

Start with these. We’ll tell you which ones matter most in your case.

  • Summons and court date. Keep the original summons, photograph both sides and put the court date and time on your calendar. Note the court named on the summons and the code section charged.
  • Driving records. Get a current driving record from every state where you have been licensed, so we see what the prosecutor and the judge will see.
  • Video and photographs. Save dash-camera footage, and photograph the location, signs, road conditions or vehicle damage before they change. Keep the original files.
  • Witness information. Write down names and contact details for passengers or anyone else who saw what happened.
  • Repair and vehicle records. Keep records of recent repairs, tire or wheel changes and any equipment problems, especially if the charge involves an accident or faulty equipment, or if speedometer testing may come up.
  • Employment and licensing concerns. Tell us about a commercial license, an out-of-state license, a security clearance, a professional license or driving you do for work.
  • Courses, community service and calibration testing. Talk with us before you pay for any of them. Whether one helps depends on your case, and the wrong choice can cost money without helping.
  • Apology letters. Don’t write or send one on your own. A letter that acknowledges what happened can be used as an admission, so check with us before you draft or submit one. Whether that concession is worth making is a strategic decision we make for your case.
  • Your own notes. While it’s fresh, write down what you remember about the stop: the time, traffic, weather and what was said.

Courses and community service

Depending on the speed, the facts and your driving record, we may recommend a driver improvement course, online or in person, and sometimes community service. These are mitigation. They can show the prosecutor and the judge how you’ve responded, but they don’t change the evidence, and no course guarantees a reduction.

Speedometer calibration

If you believe your speedometer reads low, we’ll ask about your car before suggesting a test. A calibration of your own speedometer is mitigation, not a defense, and it doesn’t show that the officer’s measurement was wrong. If the result doesn’t help, we don’t have to use it. Our speedometer calibration page explains what the test can and can’t show.

What happens on your court date in Fairfax County

In Fairfax County General District Court, an unrepresented defendant ordinarily addresses the case directly with the judge rather than negotiating with a prosecutor. When we represent you, we review the evidence and discuss possible resolutions with the prosecutor and officer.

In our experience, Fairfax County General District Court runs some of the busiest traffic dockets in Virginia. Reckless driving cases are generally heard on the 9:30 a.m. docket, usually in one of the roughly five first-floor traffic courtrooms, 1A through 1E, unless an overflow docket moves cases elsewhere. While court is in session, we meet with the prosecutor and the officer, then talk with you about any proposed resolution before you decide. The judge still decides whether to accept it.

In many Fairfax cases, we can appear for you with your written authorization, depending on the alleged speed and your driving record. Until we confirm that your appearance is excused, plan to attend. If you do attend, arrive early, come in through the front entrance and allow enough time for parking, security screening and a busy docket. We’ll tell you before your court date where to meet us.

Other courts follow their own procedures. Our Fairfax County reckless driving lawyer page covers the county courthouse in more detail.
