Cost of a Reckless Driving Lawyer in Virginia

Our flat fees for reckless driving cases typically run from $1,000 to $2,500, with higher-speed cases toward the top of that range. A case involving an accident, or one where the Commonwealth is asking for active jail time or a license suspension, may cost more. The consultation is free, and afterward we quote one fixed fee for your case, so you know the price before you decide to hire us.

The quote depends on your case, not a price list. Reckless driving is ordinarily a Class 1 misdemeanor under Virginia Code § 46.2-868, and a routine speed case with a clean record calls for different work than a crash or a very high speed. That is why we start with the actual summons.

What the flat fee covers

The written engagement agreement sets the exact scope. In a typical reckless driving case, the fee covers:

  • Reviewing the summons, the code section charged, the alleged speed or conduct, your court date and your driving and licensing concerns.

  • Planning for negotiation and for trial, and representing you at your court appearances, including any continuances and the trial itself.
  • Case-specific mitigation advice, including whether a driver improvement course makes sense and which kind.

If your case is continued or has to be tried, the fee does not change because of that. You will not get a second bill for a second court date.

What you pay separately

Fines, court costs and a driver improvement clinic’s charge are not part of the attorney fee. They are paid to the court or the clinic if they apply. Virginia DMV states that a clinic may charge no more than $100 for attendance. Why quotes differ from case to case

A flat fee means the scope and price are set before you hire us, not that every case costs the same. The quote follows the work your case is likely to need:

  • The code section charged, and whether the allegation rests on speed, a crash, vehicle control or other conduct.
  • The alleged speed, any injury or additional charge, and whether the Commonwealth is asking for active jail time or a license suspension.
  • The court and how far along the case is.
  • Your driving record, your licensing state, any commercial license and how much you depend on driving for work.
  • The evidence we need to obtain and any issues that may have to be litigated.

Ask us before you sign up for a driver improvement course

Course advice is part of the flat fee, and it is worth getting before you enroll. In our experience, clients sometimes complete a course that does not fit their court, their licensing situation or the plan for their case.

The rules explain why. Virginia DMV awards up to 5 safe driving points once every 24 months for a voluntary clinic, but a clinic taken to lower an insurance premium earns no safe driving points, and when a court requires the clinic, the court decides whether points are awarded. DMV also notes that a court may or may not accept an online clinic, and that an online clinic does not satisfy a commercial driver’s clinic requirement.

Comparing lawyers on more than price

A lower fee does not prove a lawyer is unprepared, and a higher fee does not promise a better result. What matters is what the fee covers and how the lawyer plans to handle your case. Before you hire anyone, ask whether the fee is flat or hourly, whether continuances and trial are included, what evidence the lawyer will review and which costs you will pay separately. No lawyer can promise a dismissal, a reduction or a particular sentence in advance.
